Terms of Use for ZipBiz

Welcome to ZipBiz! These Terms of Use (“Terms”) govern your access to and use of the ZipBiz website, mobile application, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and all other applicable policies. If you do not agree to these Terms, please do not use the Platform.
1. Acceptance of Terms This Platform is owned and operated by Master Solvers/ ZipBiz, located in Sahibzada Ajit Singh Nagar, Punjab, India (“ZipBiz,” “we,” “us,” or “our”). These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and ZipBiz.
2. Services Offered ZipBiz provides an online marketplace that connects users seeking various home services (e.g., Electrician, Plumber, Cleaner, Carpenter, Painter, RO Service, Caregiver, Maid, Home Salon, Appliance Repair, Pest Control, Water Tank Cleaning, Chimney/Hob Service, Desktop/Laptop Repair, Movers & Packers) with independent third-party service providers (“Service Providers”). ZipBiz acts solely as an intermediary to facilitate bookings and payments. We do not directly provide these services and are not responsible for the actual performance of the services by Service Providers.
3. User Eligibility You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.
4. User Accounts
a. To access certain features of the Platform, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify ZipBiz immediately of any unauthorized use of your account.
c. ZipBiz reserves the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or incomplete.
5. Booking and Payments
a. Booking: Users can request services through the Platform by providing details of the service required, preferred date/time, and location. Bookings are subject to Service Provider availability.
b. Pricing: Service prices are displayed on the Platform. These prices are for labor only, unless explicitly stated otherwise. Material costs, if any, will be extra and directly payable to the Service Provider. Visiting charges and commission are as outlined in the service pricing tables.
c. Payment: Payments for services booked through the Platform will be processed via Payment Gateway. You agree to pay all charges incurred under your account, including applicable taxes and surcharges.
d. Cancellation & Refunds: All cancellations and refunds are subject to our Refund and Cancellation Policy. No refunds will be processed once the service has been completed.
e. Late Payment: All invoices must be paid on the due date. Failure to pay invoices on the due date will incur late fee charges. Failure to pay invoices for more than 15 days may result in legal action/complaints.
6. User Responsibilities
a. You agree to use the Platform in a lawful manner and in accordance with these Terms.
b. You are responsible for providing a safe and accessible environment for the Service Provider to perform the services.
c. You agree to treat Service Providers with respect and professionalism.
d. You must ensure the accuracy of the service request details, including service type, location, and contact information.
e. You acknowledge that Service Providers are independent contractors and not employees or agents of ZipBiz.
f. All services are to be performed under the supervision of the customer. The customer is responsible for all work done.
g. Any issues, defects, or complaints must be reported during the service visit. No complaints will be entertained after the service has been completed.
h. Customers must cooperate with Service Providers by providing necessary tools or equipment if required (e.g., ladders, stools, cleaning tools, buckets, mugs, dusting cloths, electricity, or water supply)
7. Service Provider Responsibilities (Overview) Service Providers agree to perform services with reasonable care and skill, adhere to agreed-upon schedules, and maintain professional conduct. Detailed responsibilities are outlined in the Service Provider Policy.
8. Ratings and Reviews Users may be able to rate and review Service Providers. These ratings and reviews must be accurate, fair, and based on actual service experience. ZipBiz reserves the right to remove any content deemed abusive, defamatory, or misleading.
9. Intellectual Property All content on the Platform, including text, graphics, logos, images, software, and the compilation thereof, is the property of ZipBiz or its content suppliers and protected by intellectual property laws.
10. Disclaimers
a. As-Is Basis: The Platform and services are provided “as is” and “as available” without any warranties, express or implied.
b. No Guarantee of Service Quality: ZipBiz does not guarantee the quality, suitability, safety, or ability of Service Providers. You acknowledge and agree that the entire risk arising out of your use of the services remains solely with you.
c. Third-Party Providers: ZipBiz does not endorse, guarantee, or make any representations regarding any Service Provider. You engage Service Providers at your own discretion and risk.
d. ZipBiz is not responsible for any loss, damage, theft, or complaints regarding services performed by Service Providers.
e. Packages: ZipBiz reserves the right to alter fixed packages slightly to accommodate user requirements and fit customer budgets, without prior notice.
11. Limitation of Liability To the maximum extent permitted by applicable law, ZipBiz shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:
a. Your use or inability to use the Platform or services.
b. The conduct or statements of any third party on the Platform, including Service Providers.
c. Any unauthorized access to or alteration of your transmissions or data.
d. Any other matter relating to the Platform or services. In no event shall ZipBiz’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you to ZipBiz for the specific service giving rise to the liability.
12. Indemnification You agree to indemnify, defend, and hold harmless ZipBiz, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
a. Your access to or use of the Platform or services.
b. Your violation of these Terms.
c. Your interaction with any Service Provider or other user.
d. Your violation of any third-party rights, including intellectual property rights.
13. Governing Law and Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in Sahibzada Ajit Singh Nagar (Mohali), Punjab, India.
14. Changes to Terms ZipBiz reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Platform and updating the “Last Updated” date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
15. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
